General Terms and Conditions (English) 

1. General
The terms and conditions set out below cover all aspects of the purchase from Oxbloodoi covering but not restricted to delivery, returns and contracts. Any exceptions require prior written notice between the two parties.
Oxbloodoi is permitted to change these terms and conditions at any time, orders that were processed under the previous terms and conditions will be covered by those terms that were applicable at the time of order.

2. Our Product Offer
Our offers are not binding. Small deviations and technical changes to our illustrations or descriptions are possible.

3. Delivery and Payment
The delivery and payment terms of Oxbloodoi are in the order overview. There is no minimum order quantity. Taxation (VAT) Information can be read under point 11 of the General Terms and Conditions (below). We reserve the right to make a partial delivery if this is advantageous for a speedy settlement and meets the customers requirements. 

4. Delivery timeframe
Commodity that is in stock (we are not liable for transportation problems) is sent within 3 days (unless the status of the online shop is marked as "on vacation" in which case please see the status display on the Ebay Shop. If the goods are not in stock, we strive to deliver as soon as possible. If the delay of a delivery or lack of performance due to force majeure, labor disputes, unforeseen obstacles or other circumstances occurrs, we are not responsible and the delivery timeframe will be extended. Under failure to comply with the delivery by third-parties other than the above reasons, the buyer is entitled to put in writing, a reasonable grace period with the threat of rejection and to withdraw after the unsuccessful expiry of the terms in the contract delivery or performance of the contract. The impossibility of delivery is based on inability of the manufacturer or our supplier, we can either cancel the contract and the buyer if the agreed delivery date is exceeded by more than 2 months. Claims for damages because of delay or inability or failure to comply, including those incurred up to cancellation of the contract are excluded. Unless, that a legal representative of the company Oxbloodoi has acted deliberately or grossly negligent.

5. Returns
We do not guarantee for used (second hand or clothing marked and described as "used" or "damaged") textiles / clothing. Goods that are new can be returned within 14 days if it is damaged or too small. Postage will not be refunded for the return of the goods. The return period is preserved by the timely sending of the goods (invoice date). The return is accepted by us only if it is sufficient franked.
Returns are not accepted for discounted goods and those as part of special promotions. Furthermore, all items are sold as "USED" (e.g. shoes, clothing), as well as Music & Film (CD, LP & DVD) are excluded from exchange

6. Transfer of liability (shipping)
Oxbloodoi ist removed from liability once the goods have left our possession and are transported by a third party.

7. Guarantee
Oxbloodoi will ensure that the goods sold, at the time of transfer of liability (shipping) is free of defects in material and workmanship.
Upon receipt, the customer must inspect the goods immediately for defects and condition. In the case of obvious defects, these must be reported in writing within 10 days of discovery with a detailed description. Otherwise the guarantee for these defects will expire. The items must be returned, together with a copy of the invoice and sufficient postage.
The warranty does not cover normal wear and tear. The warranty is void if the customer modifies the product.
The customer has, during the warranty period, the right to free repair. A partial or complete replacement is allowed.
If defects are not repaired within a reasonable time, the buyer has the right to exchange or refund. This is governed by German Federal Law § 476a BGB.

8. Retention of title
The goods remain property of Oxbloodoi until full payment has been made.

9. Personal Data
According to § 28 of the Federal Data Protection Act (BDSG), we draw your attention to the fact that necessary information in the context of business data is processed and stored by a computer system according to § 33 (BDSG). Personal data is treated confidentially.

10. Jurisdiction
Performance and jurisdiction for both parties is the business seat of Oxbloodoi (Leipzig). This is governed by the law of the Federal Republic of Germany.

From 1.1.2011: Prices for items purchased by Oxbloodoi as "New Goods" are end prices and include the legal and applicable VAT (7% or 19%) and this is shown on the invoice. Items bought and sold as "used" are subject to differential taxation and therefore no VAT is shown on the invoice. (According to German Tax Law §25 UStG (Differenzbesteuerung) lt. § 14a Abs. 6 UStG) . For items purchased by buyers with an dispatch address outside the EU (European Union) the sale does not include VAT a net Invoice will be issued. (According to German Tax Law Umsatzsteuerfrei gem. §4 Abs. 1a und §18 Abs. 9 Satz 6 UStG). The buyer is then responsible for Import Taxation into their respective country.

Nachstehende Allgemeine Geschäftsbedingungen gelten für alle Verträge, Lieferungen und sonstige Leistungen. Abweichenden Vorschriften des Vertragspartners widersprechen wir hiermit ausdrücklich. Alle Nebenabreden bedürfen der schriftlichen Bestätigung unsererseits.
Oxbloodoi ist jederzeit berechtigt, diese Allgemeinen Geschäftsbedingungen einschließlich aller eventuellen Anlagen mit einer angemessenen Kündigungsfrist zu ändern oder zu ergänzen. Vorher eingehende Aufträge werden nach den dann noch gültigen alten Allgemeinen Geschäftsbedingungen bearbeitet.

2. Angebot
Unsere Angebote sind unverbindlich. Kleine Abweichungen und technische Änderungen gegenüber unseren Abbildungen oder Beschreibungen sind möglich.

3. Lieferung und Zahlung
Die Lieferungs- und Zahlungsbedingungen von Oxbloodoi sind im Bestellformular näher ausgewiesen. Es gibt keine Mindestbestellmenge. Steuerliche Informationen sind unter Punkt 11 zu lesen. Es bleibt uns vorbehalten, eine Teillieferung vorzunehmen, sofern dies für eine zügige Abwicklung vorteilhaft erscheint. Von unseren Kunden gewünschte Sonderversendungsformen werden mit ortsüblichem Zuschlag berechnet.

4. Lieferzeiten
Ware, die am Lager ist (für Beförderungsprobleme haften wir nicht) kommt innerhalb von 3 Tagen zum Versand. Ausgenommen sind Zeiten wenn der Verkäufer den Ebay Shop" Status auf "Urlaub" gesetzt hat, in diesem Fall stehen Zeitraum der Abwesenheit und andere Informationen auf jede Seite der "Shop Überschrift". Ist die Ware bei Bestellung nicht vorrätig, bemühen wir uns um schnellstmögliche Lieferung. Falls die Nichteinhaltung einer Liefer- oder Leistungsfrist auf höhere Gewalt, Arbeitskampf, unvorhersehbare Hindernisse oder sonstige von uns nicht zu vertretende Umstände zurückzuführen ist, wird die Frist angemessen verlängert. Bei Nichteinhaltung der Lieferfrist aus anderen als den o. g. Gründen ist der Käufer berechtigt, schriftlich eine angemessene Nachfrist mit Ablehnungsandrohung zu setzen und nach deren erfolglosem Ablauf hinsichtlich der im Vertrag befindlichen Lieferung oder Leistung vom Vertrag zurückzutreten. Beruht die Unmöglichkeit der Lieferung auf Unvermögen des Herstellers oder unseres Zulieferers, so können sowohl wir als auch der Käufer vom Vertrag zurücktreten, sofern der vereinbarte Liefertermin um mehr als 2 Monate überschritten ist. Schadensersatzansprüche wegen Verzug oder Unmöglichkeit bzw. Nichterfüllung, auch solche, die bis zu Rücktritt vom Vertrag entstanden sind, sind ausgeschlossen. Es sei denn, daß ein gesetzlicher Vertreter der Firma Oxbloodoi vorsätzlich oder grob fahrlässig gehandelt hat.

5. Rückgaberecht
Wir garantieren für nicht benutzte / gebrauchte Textilien ein Rückgaberecht innerhalb von 14 Tagen, wenn diese beschädigt oder zu klein/gross sind. Die Rückgabefrist wird gewahrt durch das fristgerechte Absenden der Ware (Rechnungsdatum). Die Rücksendung wird von uns nur angenommen, wenn sie ausreichend frankiert wurde.
Das Rückgaberecht ist nicht gültig für preisreduzierte Ware und anläßlich von Sonderverkaufsaktionen. Weiterhin sind alle Artikel die als "Gebraucht" (z.B. Schuhe, Kleidung) aber weiterhin Musik & Film (CD,LP & DVD) grundsätzlich vom Umtausch ausgeschlossen!


6. Gefahrübergang

Die Gefahr geht mit Absendung der Ware durch Oxbloodoi auf den Käufer über.

7. Gewährleistung
Oxbloodoi gewährleistet, daß die verkaufte Ware zum Zeitpunkt des Gefahrüberganges frei von Material- und Fabrikationsfehlern ist und die vertraglich zugesicherten Eigenschaften hat.
Bei Eintreffen hat der Kunde die Ware unverzüglich auf Mängel und Beschaffenheit zu untersuchen. Im Falle offener Mängel müssen diese innerhalb von 10 Tagen nach Entdeckung schriftlich bei uns gemeldet werden, ebenso versteckte Mängel. Anderenfalls entfällt die Gewährleistung für diese Mängel. Bei Reklamationen muß das Kaufdatum mit einer Rechnung nachgewiesen werden. Der reklamierte Artikel muß zusammen mit einer Kopie der Rechnung, ausreichend frankiert, eingeschickt werden.
Die Gewährleistung erstreckt sich nicht auf den normalen Verschleiß oder die Abnutzung. Die Gewährleistung erlischt, wenn der Kunde die gelieferte Ware verändert.
Oxbloodoi hat während der Gewährleistungspflicht das Recht auf kostenlose Nachbesserung. Ein teilweiser oder vollständiger Austausch des Artikels ist zulässig.
Werden Mängel innerhalb angemessener Frist nicht behoben, so hat der Käufer Anspruch auf Wandlung oder Minderung. Es gilt § 476a BGB.

8. Eigentumsvorbehalt
Bis zur vollständigen Bezahlung bleibt die Ware Eigentum der Firma Oxbloodoi.

9. Datenspeicherung
Gemäß § 28 des Bundesdatenschutzgesetzes (BDSG) machen wir darauf aufmerksam, daß die im Rahmen der Geschäftsabwicklung notwendigen Daten mittels einer EDV-Anlage gemäß § 33 (BDSG) verarbeitet und gespeichert werden. Persönliche Daten werden selbstverständlich vertraulich behandelt.

10. Gerichtsstand
Erfüllungsort und Gerichtsstand für beide Teile ist der Sitz von Oxbloodoi. Es gilt ausschließlich das Recht der Bundesrepublik Deutschland.
