Etliche Common Law-Staaten haben unlängst ihr von althergebrachten Regeln geprägtes Dienstbarkeitsrecht fortentwickelt und teilweise reformiert. In seinem Werk befasst sich Egmont Neubauer mit dem Recht der Grunddienstbarkeiten (easements) in England und Wales, der Mutterrechtsordnung des angloamerikanischen Rechtskreises. Hierbei legt er ein besonderes Augenmerk auf den im Juni 2011 veröffentlichten Reformvorschlag der englischen Law Commission zur Reform der Dienstbarkeiten. Als Brückenschlag zum deutschen Recht, welches er in eine rechtsvergleichende Analyse einbettet, stellt der Autor auch die servitudes der schottischen Mischrechtsordnung aus Common Law und Civil Law dar. Die Untersuchung zeigt, dass alle drei Rechtsordnungen trotz ihrer Systemunterschiede und teils stark divergierender Rechtsregeln in Kernfragen vorwiegend funktionell vergleichbare Lösungen gefunden haben.
