However my experience was different, the seller marked the item as dispatched/untracked, acknowledged that he didn't send the items yet, then stopped responding to any of my messages. ebay helpfully issued a refund. I would be more inclined to give the seller the benefit of the doubt if he didn't use dispatched/untracked, from my point of view it looks like a scam.
