Seller described item as new in box which. Item was a high dollar Diecast car
Item arrived severely scratched from store bought napkins that the seller stuffed into the clamshell on top of the car
The clamshell was never secured with tape, so the car moved around freely during shipping causing the severe scratching on the top half of the car from the store bought napkins
Seller refused to let me return the car. Thank you EBay for reviewing this case and settling it in my favor.

The item was advertised as new in box. As pictured the box has some wear. However the item was not new, box was previously opened, item was stuffed into box with various bubble wraps and scotch tape on inside of box.
The item itself did not function at all. Thought perhaps a battery issue, replaced batteries to find none original batteries in item and scratches battery casing.
Contacted seller who denies that item doesn’t work.
