My item was new in the box sealed as advertized. phone although was great it had a factory defect in the 3.5 mm earphone jack (I think)no sound left channel. I contacted the vendor and received a return shipping tag. the vendor keep in contact via email and text until they received the item. received a refund as stated. VERY happy with this vendor and will continue to purchase though them on ebay
