Fraglich ist jedoch zun chst, was der Arbeitnehmer leisten muss. Diese h ngt wesentlich vom Arbeitsver-trag ab. Bei Durchsicht einer Vielzahl von Arbeitsvertr gen wird schnell deutlich, dass bei der Ermittlung der Normalleistung der Arbeitsvertrag nur von sekund rer Bedeutung sein kann, da eine Wechselbeziehung zwischen Direktionsrecht und Arbeitsvertrag erkennbar ist und so keine R ckschl sse auf einen Leistungsma stab gezogen werden k nnen. F r die Festlegung des Solls bedarf es vielmehr der Einf hrung eines Leistungsma stabs. Dieser erf hrt in Litera-tur und Rechtsprechung eine Zweiteilung. Es stehen sich die zwei Grundpositionen, der sub-jektiven, also dem individuellen, pers nlichen Leistungsverm gen und der objektive Leis-tungsma stab, welches sich in der objektiven Durchschnittsleistung ausdr ckt. Nach der Feststellung des relevanten Leistungsma stabs werden weitere Anforderungen an die sozial ge-rechtfertigte K ndigung formuliert, die im Folgenden er rtert werden. Dies beinhaltet eine Zwischenl sung von objektiven und subjektiven Gesichtspunkten in der Form der abgestuften Darlegungslast, welche eine Beweislasterleichterung f r den Arbeitgeber zur Folge haben kann. Danach soll dargestellt werden, wie diese Beweislasterleichterung durch die ein-Drittel Regelung relativiert wird.
