Il suddetto decreto definisce consumatore "la persona fisica che agisce per scopi non riferibili all'attività professionale eventualmente svolta". Questo diritto è perciò esercitabile solo da coloro che acquistano come persone fisiche per scopi personali non riconducibili alla propria attività lavorativa. Restano dunque esclusi da questo diritto tutti coloro che acquistano come persone giuridiche per scopi inerenti ad attività commerciali e indicano quindi nell’ordine la partita IVA. Il diritto di recesso si esercita con l'invio, entro il termine previsto, di una comunicazione scritta mediante lettera raccomandata con ricevuta di ritorno all'indirizzo del venditore presente su E-Bay. Al consumatore sarà rimborsato l’importo da lui pagato per il bene acquistato, decurtato di 2,00 (due,00) EURO per le spese bancarie/commessioni PayPal e di gestione. Sono escluse dal rimborso le spese di spedizione che non sono di competenza del venditore.

L'importo netto sarà rimborsato entro 30 giorni dal ricevimento della merce restituita, via bonifico bancario o tramite conto PayPal.
