Bei der historischen und juristischen Bewertung der Luftkriegspraxis des Zweiten Weltkrieges wurde bisher allgemein angenommen, dass bei Kriegsausbruch keine brauchbaren volkerrechtlichen Regeln uber den Schutz der Zivilbevolkerung vor Luftbombardements bestanden hatten und deshalb eine objektive Beurteilung nicht moglich sei. Diese These soll durch die vorliegende Studie widerlegt werden. Hier wird nicht nur die Kodifikationsgeschichte des Luftkriegsrechts behandelt, sondern erstmals die Entstehung eines Volkergewohnheitsrechts unter Berucksichtigung der Luftkriegspraxis bis 1939, der einzelnen Luftkriegsdoktrinen sowie der technischen Entwicklung dokumentiert. Die Hinzuziehung von bisher unveroffentlichten Archivalien bestatigt die Existenz einer hinsichtlich von Luftbomardements konkreten Rechtsuberzeugung sowohl bei den Militars als auch den Politikern der am Zweiten Weltkrieg beteiligten Machte."
