When I contacted the seller they pointed out that in the description it stated as open box. There is no excuse for (a) not selected Open Box in the condition field, and for (b) misrepresenting a damaged item as open box. The seller offered only one option - to send it back. As I really wanted to use this item, and the price was fair I have decided to keep it.
